Terms of service
These terms govern the website design, hosting, and maintenance services provided by MJM Design under the Water Dealer Pro name.
1. Scope of these terms
Water Dealer Pro is a service of MJM Design of Columbus, Ohio. These terms apply to all website design, hosting, and maintenance services ordered through this website or by telephone. In these terms, "we" and "us" refer to MJM Design, and "you" and "the client" refer to the dealership ordering the service. Placing an order constitutes acceptance of these terms.
2. Fees and billing
Each plan consists of a one time setup fee and a recurring monthly service fee. Current fees for all plans are published on the pricing page. Both the setup fee and the first monthly payment are charged at the time the order is placed. The monthly fee then recurs on that same date each month until the service is terminated.
Charges appear on your statement as MJM DESIGN. Fees are quoted in United States dollars and are exclusive of any applicable taxes. There is no minimum term and no long term contract. Clients who began service before 2026 retain their original monthly rate.
Online card payments are processed by Stripe. Card details are entered on Stripe's secure payment page and are not stored on this website or on our servers. Where online payment is not available, payment may be arranged by telephone or by invoice.
3. Refunds
The setup fee is fully refundable at any time before the first design draft is delivered to you. Once the first draft has been delivered, the setup fee is considered earned and is no longer refundable, as the design work has been performed.
Monthly service fees are not prorated. A monthly fee that has already been charged covers service through the end of that billing period and is not refunded in part.
4. Term and cancellation
The monthly service continues on a month to month basis. Either party may terminate the monthly service by providing notice to the other. Notice may be given by telephone at 1-877-614-6144 or in writing using the details on our contact page.
Termination takes effect at the end of the billing period for which payment has already been made. Your website and all included services remain fully active through the end of that period.
5. Website licensing and ownership
The website is delivered and maintained as an ongoing service rather than as a one time purchase of software. The designs, page templates, layouts, and underlying code remain the intellectual property of MJM Design and are licensed to you for the duration of your subscription.
Because hosting and the license are provided as part of the monthly service, the website is removed from our servers when the monthly service ends. Your domain name and your content are unaffected by this and remain yours, as set out in section 6.
A perpetual license, under which you would own the completed site outright, is available for most plans. This is quoted separately and is available both before a project begins and at a later date. Please contact us if you would like a quotation.
6. Client content and domain name
Your domain name is registered in your business name and remains your property at all times. All content you supply or that we produce on your behalf, including text, photographs, customer reviews, and customer records, remains your property.
If you end the service, your content and your domain remain yours and we will provide reasonable assistance in transferring them to you or to another provider at no additional charge.
You confirm that you hold the necessary rights to any logos, photographs, or other materials you supply to us for use on your website.
7. Services included in the monthly fee
The monthly service fee covers hosting, SSL certification, routine backups, security updates, uptime monitoring, and content edits to existing pages. Content edits are ordinarily completed within one to two business days of request.
Substantial redesigns, additional page templates, and features beyond the scope of your plan are not included. These are quoted separately and are undertaken only after the quotation has been accepted.
8. Client responsibilities
Delivery timelines depend on the timely provision of materials by both parties. To build your website we require your logo, photographs or permission to use stock imagery, your service area and business hours, and access to your domain name.
The twenty four hour launch period offered on One-Page Launch plans begins once we have received these materials together with your written approval to proceed.
9. Kinetico co-op funds
Many dealers seek reimbursement of their setup fee through the Kinetico co-op advertising program. We will provide an itemized invoice suitable for submission. Approval of any claim rests solely with Kinetico Incorporated and your regional representative. We are unable to guarantee reimbursement and are not a party to that decision.
10. Limitations
We do not guarantee specific search engine rankings, traffic volumes, or sales results. We undertake to deliver a technically sound, accurate, and brand compliant website together with the local search optimization work described in your plan.
While we aim for uninterrupted availability, no hosting service can guarantee continuous uptime. In the event of an outage or fault we will restore service as promptly as reasonably practicable. Our total liability arising from the service is limited to the fees paid by you in the twelve months preceding the claim.
11. Independence from Kinetico Incorporated
Water Dealer Pro is an independent service of MJM Design provided to authorized, independent Kinetico dealers. We are not Kinetico Incorporated, we are not an agent of Kinetico Incorporated, and we do not speak on its behalf. Kinetico and the Kinetico logo are trademarks of Kinetico Incorporated and are used here solely to identify the dealers we serve.
12. Governing law and disputes
These terms are governed by the laws of the State of Ohio. In the event of a dispute, we ask that you first contact us by telephone at (614) 432-8811 extension 101 so that the matter may be resolved directly.
13. Changes to these terms
We may update these terms from time to time. The revision date below indicates when they were last amended. Material changes affecting existing clients will be communicated in advance.
